DISABILITY DISCRIMINATION

FMLA

The Family Medical and Leave Act ("FMLA") grants eligible employees up to a total of 12 weeks of unpaid leave during any 12-month period for personal illness or illness of a family member. The FMLA is administered and enforced by the U.S. Department of Labor and applies to all public agencies including state, local and federal employers and private employers who have 50 or more employees during 20 weeks of the year and who are engaged in commerce or an activity affecting commerce. As you can understand, this means that most large private employers do fall under provisions of the FMLA.

One of the main points of the FMLA is that upon returning from approved FMLA leave, an employee must be restored to his or her original job or to an equivalent job with equivalent pay and benefits.
